Street Interview Consent

Dear Interviewer (“You,” “Your”),
Thank you for taking part in this street interview for our upcoming game Nightholme (“Nightholme Street Interview”). You will be recorded by Studio Ellipsis, Unipessoal, Lda, Avenida Duque De Loulé, 1050-090 Lisbon, Portugal, and its affiliated companies (“Studio Ellipsis,” “We”) in connection with Nightholme. During the interview, we will record your image, name, voice, and any answers or statements you make ("Personal Data"). If you choose to share information about topics such as your health, religion or philosophical beliefs, political opinions, sexual orientation, racial or ethnic origin, or trade union membership, this will be treated as "Special Category Data" and will only be included in the published video with your separate, explicit consent
We may use recordings, edited or unedited, to create pictures, videos, clips, or podcasts (“Publication Materials”). We will never publish Personal Data or Publication Materials showing you in a way that could reasonably cause you embarrassment or distress.
Because this involves your Personal Data, GDPR requires your explicit consent before we can use it. Please read the Consent section to give (or decline) that consent.
How We Use Your Personal Data
With your consent, we may:
Cut, edit, and process your Personal Data to create Publication Materials.
Use your Personal Data and Publication Materials for marketing, advertising, branding, PR, partner and company presentations (e.g. events, training, seminars), our website, and other promotion connected to Studio Nightholme games (“Purposes”).
Publish your Personal Data and Publication Materials on Studio Ellipsis Communication Platforms, including social media (e.g. Facebook, Instagram, LinkedIn, YouTube, TikTok, Discord, podcasts), websites, newsletters, and advertising placements, worldwide.
Once published, your image and Personal Data are in the public domain and may be reproduced by others outside our control.
Who Can Access Your Data
Your Personal Data and Publication Materials are stored in Studio Ellipsis’ secured internal systems, accessible only to authorised employees on a need-to-know basis, and are also shared with our data processor on our behalf under a data processing agreement requiring them to protect your Personal Data in accordance with applicable data protection law.
Your Rights
Under applicable data protection law and our Privacy Policy, you have the right to access, rectify, erase (in certain cases), restrict, or object to the processing of your Personal Data, and a right to data portability (in certain cases). You may also lodge a complaint with your national data protection supervisory authority.
You may withdraw your consent at any time, without giving a reason, by emailing privacyoffice@studiellipsis.com. Once we receive your withdrawal, we will stop further use of your Personal Data. We cannot retract Publication Materials already published or shared before your withdrawal.
International Transfers
Your Personal Data and Publication Materials may be transferred to Studio Ellipsis’s parent companies, subsidiaries, affiliates, and related entities (“IP Owner”), including outside the EEA, using appropriate safeguards required by applicable data protection law as described in our Privacy Policy, https://www.studioellipsis.com/privacy-policy.
How Long We Keep Your Data
Personal Data not used for the Purposes above will be securely deleted after 6 months.
CONSENT
You hereby give consent for Studio Ellipsis to:
Process your Personal Data from the Nightholme Street Interview and create Publication Materials from it;
Publish and tag your Personal Data and Publication Materials on Studio Ellipsis Communication Platforms;
Use your Personal Data and Publication Materials for the Purposes described above.
You confirm that this consent is voluntary, and that you understand your right to withdraw it at any time as described above.
Special Category Data (Sensitive Personal Data)
We need your explicit consent if during the interview, you share information about topics such as your health, religion or philosophical beliefs, political opinions, sexual orientation, racial or ethnic origin, or trade union membership ("Special Category Data").
Special Category Data will only be included in the published video if you separately and explicitly agree below. This is in addition to, and separate from, the general consent given in Section 1.
You understand that even if you tick the first box above, Studio Ellipsis will separately check with you on camera at the time of disclosure to confirm you are comfortable with that specific statement being included, before it is used in the final edit.
You also confirm and agree that:
1 - You are of legal age and not bound by any exclusive contract governing use of your Personal Data.
2 - Studio Ellipsis and the IP Owner own the copyright in the Publication Materials, and you grant them a worldwide, royalty-free, perpetual licence to all rights (including moral rights and copyright) in the Nightholme Street Interview recordings and Publication Materials, assigning such rights where legally required.
3 - You will not receive payment and waive any claim to compensation, publicity rights, or privacy rights in connection with the Publication Materials.
4 - You release Studio Ellipsis from claims arising from this use, including claims of privacy invasion, image-rights infringement, or defamation, to the extent permitted by law.
5 - You took part voluntarily and release Studio Ellipsis from liability for costs, injury, or loss arising from your participation, to the extent permitted by law.
